IMPORTANT NOTICE: PLEASE READ CAREFULLY
DIVVIO IS A SOFTWARE PROVIDER, NOT A LAW FIRM. WE DO NOT PROVIDE LEGAL ADVICE.
These Terms of Service ("Terms") govern your use of the Divvio web application and services ("Service"), operated by Kintela Ltd ("we", "us", "our"). By accessing or using Divvio, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Divvio is a self-help document preparation tool. We provide a platform for you to input your financial information and generate a Form E (Financial Statement) in a PDF format suitable for family court proceedings in England and Wales.
We are not solicitors, barristers, or legal advisors. We are not regulated by the Solicitors Regulation Authority (SRA). The content, guidance, and "AI Co-pilot" features provided are for informational purposes only and do not constitute legal advice.
Use of Divvio does not create a solicitor-client relationship. Your communications with us are not protected by legal professional privilege.
You are solely responsible for:
The final PDF output is a direct reflection of the data you input. We do not verify, audit, or check your data for legal sufficiency, errors, or omissions.
We guarantee that the layout and formatting of the PDF generated by Divvio complies with the standard Form E (01/23) specification used by the Family Court.
If the court rejects your Form E specifically due to formatting or layout errors caused by our software, we will:
This is your sole and exclusive remedy for formatting issues. We are not liable for rejections based on the content of your answers, missing attachments, or procedural errors on your part.
You acknowledge that Form E requires "full, frank, and clear disclosure" of your financial circumstances. Deliberately hiding assets or providing false information to the court is a serious offence (contempt of court) and can lead to criminal penalties. Divvio is not liable for any user who uses the Service to conceal assets.
You are responsible for gathering and attaching the necessary evidence (bank statements, P60s, valuations) as indicated in the "Document Checklist." Divvio does not obtain these documents for you.
Fees for the "Solo" and "Couple Bundle" plans are payable at the point of export or account upgrade. Prices are inclusive of VAT unless stated otherwise.
Outside of the "Rejection Remedy" in clause 3.3, we offer a 14-day money-back guarantee provided you have not yet downloaded the final court-ready PDF. Once the final PDF has been generated and downloaded, the service is deemed fully consumed, and no refunds will be issued unless required by consumer law.
To the maximum extent permitted by law, our total liability to you for any claims arising out of or related to these Terms or the Service (whether in contract, tort, or otherwise) is limited to the amount you paid to us for the Service.
We shall not be liable for:
The "AI Co-pilot" provides automated suggestions based on patterns. We do not guarantee the accuracy of AI-generated text or explanations. You must verify all AI suggestions before accepting them.
We use bank-level encryption (AES-256) to store your data and SSL/TLS for data in transit. However, no internet transmission is 100% secure.
You may request the deletion of your data at any time via your dashboard. Once deleted, your data cannot be recovered.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
